Terms of Service
These terms cover your use of Filmi, a free iPhone app that alerts you when sold-out seats open up at AMC theaters and keeps track of the movies you see, and of filmi.us. In these terms, "Filmi", "we" and "us" mean the independent developer who runs the app, and "you" means anyone who uses it. By using Filmi, or by creating an account, you agree to these terms and acknowledge our Privacy Policy, which explains what we store and how to delete it. If you don't agree, please don't use Filmi.
The short version
- Filmi is an independent app. It isn't made, endorsed or sponsored by AMC Theatres.
- Seat and showtime information comes unofficially from AMC's public website. It can be wrong, late or missing, and a seat that opens up may be gone before you book it.
- Filmi doesn't sell tickets or hold seats. You book on AMC, under AMC's own terms.
- Filmi is free and provided as is. Use it fairly and don't try to break it.
Filmi and AMC
Filmi is an independent app and is not affiliated with, endorsed by, or sponsored by AMC Theatres. "AMC" and related marks are the property of their respective owners. We use AMC's name only to describe the theaters Filmi works with.
Filmi doesn't sell tickets, reserve or hold seats, or have access to your AMC account. "Book on AMC" opens AMC's website, and any purchase you make there is between you and AMC, under AMC's terms and policies. Questions about tickets, refunds or your AMC membership go to AMC, not to us.
Seat and showtime information
AMC has no public API. Filmi gets theaters, showtimes and seat maps by reading AMC's public website, without AMC's involvement. That information is unofficial and provided on a best-effort basis:
- it may be inaccurate, incomplete, out of date or delayed
- seat checks run periodically, not in real time, so a seat can open and be taken again between checks, and a seat Filmi reports as open may already be gone by the time you try to book it
- push notifications depend on Apple, Expo, your phone's settings and your connection, and may arrive late or not at all
- some theaters, showtimes or seat maps may not be available in Filmi, and AMC can change its website in ways that stop Filmi working, for a while or for good
Always check seats, prices and showtimes on AMC before you buy or travel, and don't rely on Filmi as your only way of getting a seat. Savings figures in the app are estimates based on the prices you enter and your membership plan, not financial or accounting advice.
Who can use Filmi
You must be at least 13 years old to use Filmi. If you're under 18, you need a parent or guardian's permission. Filmi is offered in the United States only.
Your account
- You can use Filmi without an account: the app creates an anonymous one for your device. If you delete the app or lose your phone before creating an account, you can't get that data back.
- If you create an account, give a real email address you can receive mail at, keep your password to yourself, and tell us at support@filmi.us if you think someone else has used it. You're responsible for what happens in your account.
- You can delete your account and everything in it at any time from Profile → Delete account.
Your content
What you put into Filmi, such as alerts, tickets, notes and tags, stays yours. You give us permission to store, copy and process it only as needed to run Filmi for you, as described in the Privacy Policy. That permission ends when you delete it or your account, apart from the short-lived copies the Privacy Policy describes.
Using Filmi fairly
You agree not to:
- use Filmi to break the law, or anyone else's rights or terms
- use Filmi for commercial purposes, including to buy, hold or resell tickets or seats for others
- get around the app's limits, for example on active alerts, favorite theaters or saved seat maps, including by creating extra accounts
- access Filmi's servers or data other than through the app, or use bots, scripts or other automation against them
- copy, resell or redistribute the seat and showtime information Filmi shows, or build a competing service from it
- probe, overload or interfere with Filmi, its servers or other users, or try to reach anyone else's data (if you find a security problem, please email us instead)
- impersonate someone or use an email address that isn't yours
Limits in the app, like how many alerts you can have, may change as we learn what keeps Filmi running well for everyone.
Filmi itself
We own Filmi, including its name, design and code. As long as you follow these terms, you may use the app for your own personal, non-commercial use. Movie details and images come from TMDB. This application uses TMDB and the TMDB APIs but is not endorsed, certified, or otherwise approved by TMDB.
Other services
Filmi links to and relies on services we don't control, including AMC's website, TMDB, Apple and Expo for notifications, and Ko-fi for the optional tip jar. Those services have their own terms and privacy policies, and we aren't responsible for them. Tips are voluntary, go through Ko-fi, and don't buy any feature, priority or refund.
Changes, suspension and ending
Filmi is a free app from an independent developer. We may change, pause or stop any part of it, or all of it, at any time, and we'll try to give notice in the app when we can. We may suspend or delete accounts that break these terms or put Filmi or its users at risk. You can stop using Filmi at any time, and delete your data as described above.
Disclaimers
Filmi is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise that Filmi, its seat and showtime information, or its notifications will be accurate, timely, uninterrupted or error-free, or that you'll get any particular seat.
Limitation of liability
To the fullest extent the law allows, we won't be liable for any indirect, incidental, special, consequential or punitive damages, or for missed seats, showtimes or bookings, tickets you bought or didn't buy, travel, or lost data, arising from your use of Filmi. Our total liability for any claim about Filmi is limited to US$50. Some places don't allow some of these limits, so they may not all apply to you.
Apple
If you got Filmi from Apple's App Store or TestFlight: these terms are between you and us, not Apple, and we, not Apple, are responsible for Filmi and its support. Apple has no obligation to provide maintenance or support for it. If Filmi fails to meet any warranty that applies to it, you may tell Apple, and Apple will refund any purchase price (Filmi is free, so there is none). Apple isn't responsible for any claims about Filmi, including product liability, legal or regulatory claims, or claims that Filmi infringes someone's intellectual property; we are, as far as these terms say. You confirm that you aren't in a country subject to a U.S. government embargo and aren't on a U.S. government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You also agree to follow Apple's App Store terms.
Changes to these terms
We may update these terms. We'll post the new version here with a new date at the top, and tell you in the app before a significant change takes effect. If you keep using Filmi after that, you're agreeing to the updated terms.
General
These terms and the Privacy Policy are the whole agreement between you and us about Filmi. If part of these terms can't be enforced, the rest still applies. If we don't enforce a term straight away, we haven't given up the right to later.
These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute about Filmi or these terms will be handled only in the state or federal courts located in New York, and you and we agree to those courts' jurisdiction. This doesn't take away any rights you have under the consumer protection laws where you live.
